ICTR Appeals Chamber upholds Nshogoza conviction 17 Mar 2010

On 15 March 2010, the Appeals Chamber of the International Criminal Tribunal for Rwanda (ICTR) upheld Léonidas Nshogoza`s conviction for contempt of the Tribunal. The Chamber also upheld Nshogoza’s sentence of 10 months’ imprisonment, as imposed by Trial Chamber III on 2 July 2009.

The Appeals Chamber, with Judges Patrick Robinson and Mehmet Güney partially dissenting, found that the accused had failed to demonstrate any error in the Trial Chamber’s assessment of the aggravating factors surrounding his offence. Nshogoza had requested the Chamber reverse his conviction and enter a complete acquittal, or alternatively reduce his sentence.

Léonidas Nshogoza was an investigator in the Defence team during the trial of Jean de Dieu Kamuhanda, a convicted génocidaire at the ICTR. According to the Indictment dated 24 December 2007, Nshogoza was charged with two counts of contempt of the Tribunal and two counts of attempting to commit acts punishable as contempt for disclosing the protected information of witnesses.

On 2 July 2009 Trial Chamber III found Nshogoza guilty of one count of contempt. He was sentenced to 10 months' imprisonment, but after being given credit for time already served was immediately released.
