Dispute regarding Navigational and Related Rights (Costa Rica v. Nicaragua) fr

On 29 September 2005, Costa Rica brought a case against Nicaragua before the International Court of Justice (ICJ) regarding a dispute concerning navigational and related rights of Costa Rica on the San Juan River. According to Costa Rica, Nicaragua imposed a number of restrictions on the navigation of Costa Rican boats and their passengers on the San Juan River and that these restrictions were of a continuing character. Costa Rica claims that this is in violation of the Treaty of Limits, which granted sovereignty over the San Juan River to Costa Rica, but that also recognised important rights to Costa Rica. Costa Rica has requested the ICJ to adjudicate in this dispute and to determine reparations.

As a basis for the ICJ’s jurisdiction, Costa Rica invokes the declarations of acceptance of the Court’s jurisdiction made by Costa Rica and Nicaragua, as well as the Tovar Caldera Agreement and the Pact of Bogotá.
