Presentation of the case
Neđo Samardžić was a member of the Army of the so-called Serb Republic of Bosnia and Herzegovina (BiH). He was found guilty by the Appellate Panel of the War Crimes section of the Court of BiH of persecution on national, ethnical, religious and gender grounds of the Bosniak civilian population of the Foča municipality and sentenced to 24 years’ imprisonment.
Neđo Samardžić was found guilty of having reduced Bosniak women into sexual slavery through the rape and other inhumane acts. The Foča cases before the Court of BiH and the ICTY established an important jurisprudence regarding the rape as a crime against humanity.
