Presentation of the case
On 9 June 2006, the Trial Panel of the Court of Bosnia and Herzegovina (BiH) confirmed the indictment against Goran and Zoran Damjanović, in which they were charged with one count of torture as a war crime against civilians. Goran Damjanović also faces a separate charge of illegally manufacturing and trading in weapons or explosive materials.

According to the indictment, both Goran and Zoran Damjanović were members of the Army of the Serb Republic of BiH. On 2 June 1992, they both played a prominent part in the beating of a group of about 20 to 30 male Bosniak prisoners. The prisoners were captured earlier that day by Serb military forces during the over-running of the settlement of Ahatovići and all of them were placed hors de combat.

The Trial Panel’s verdict of 18 June 2006 found the accused guilty and sentenced Goran Damjanović to 12 years of imprisonment and Zoran Damjanović to 10 years and 6 months of imprisonment. On 19 November 2007, the Appellate Panel upheld the Trial Panel’s verdict but for the charges of illegal manufacturing and trade of weapons or explosive substances.
