In this case, Robert Thorpe accused the then Prime Minister of the state of Victoria, Jeffrey Kennett, of genocide. Robert Thorpe referred, among other things, to Jeffrey Kennett’s refusal to recognise the Gunai as a sovereign people. The Supreme Court of Victoria adopted the reasoning of the majority in the Nulyarimma case and in the Sumner case to hold that genocide was not recognised as part of the criminal law in Australia.
