Presentation of the case
In 2006, The ICTY Referral Bench referred the case against Mitar Rašević and Savo Todović pursuant to Rule 11bis of the Tribunal’s Rules and Procedures to the Court of Bosnia and Herzegovina.
According to the indictment, both men participated in a joint criminal enterprise (JCE) that came into existence in April 1992 and continued until October 1994. The purpose of the JCE was to imprison Muslim and non-Serb civilians from Foča and the surrounding areas in inhumane conditions in the Foča KP Dom and subject them to beatings, torture, enslavement, deportations and forcible transfers. The Foča KP Dome was one of the largest prisons in the former Yugoslavia and it became the primary detention facility for non-Serb detainees. The majority of the detainees was exchanged, release or disappeared during 1992 and 1993. Rašević was the commander of the KP Dom guards and he supervised at least 37 guards. Todović was the deputy commander of the KP Dom prison staff from April 1992 to August 1993.
On 28 February 2008, Rašević and Todović were found guilty of Crimes against humanity and sentenced respectively to eight years and six months of imprisonment, and twelve years and six months of imprisonment.
