Ntawukuriryayo trial begins at ICTR 06 May 2009
The trial of Dominique Ntawukuriryayo, accused of genocide in Rwanda in 1994, has begun before the International Criminal Tribunal for Rwanda (ICTR).

Dominique Ntawukuriryayo is accused of genocide at the ICTR in Arusha.On Wednesday 6 May 2009, the third new trial in 2009 got underway at the International Criminal Tribunal for Rwanda (ICTR) as proceedings began against former sub-préfet of Gisagara, Dominique Ntawukuriryayo.

Dominique Ntawukuriryayo is charged with genocide, complicity in genocide, as well as direct and public incitement to commit genocide for his actions in Butare from April until July 1994. The Prosecution alleges that Ntawukuriryayo gathered soldiers, gendarmes, and ammunition for the purpose of killing Tutsis in the préfecture. He is also alleged to have encouraged the killing of Tutsis at roadblocks following the death of President Habyarimana, as well as publicly demanding civilians to exterminate Tutsis.

According to the indictment, Ntawukuriryayo bears responsibility for the ‘Kabuye hill massacre’, where up to 25,000 civilians are thought to have been killed between 21 and 25 April 1994.

European Court of Human Rights

Ntawukuriryayo was arrested in France in 2007 following a warrant of arrest issued by the ICTR. Prior to his transfer to the custody of the Tribunal on 5 June 2008, lawyers for the accused génocidaire challenged his transfer before the European Court of Human Rights (ECHR). In May 2008, the ECHR upheld the decision of a French Court of Appeal to transfer the accused to Arusha. The Court of Appeal had re-examined the Cour de Cassation’s ruling to overturn the decision of the Paris Appeals Court authorising his transfer.

Ntawukuriryayo is the third accused transferred by France to the ICTR.
